What the Law Covers?
The bill, known as PL 2,338/2023, was passed on December 10. It creates rules for using AI in Brazil while encouraging innovation. High-risk AI systems, like those used in healthcare or public safety, will face strict oversight.

Some practices will not be allowed. These include using AI for autonomous lethal weapons, creating harmful materials, or limiting public services based on behavior.
Companies must get permission to use copyrighted content for AI-generated material. They will also need to pay creators for their work.
Stricter Oversight
A new governance system will oversee AI use in Brazil. The system will involve government agencies like the Central Bank and Anvisa. Fines of up to R$50 million or 2% of revenue will apply for breaking the rules. The plan was introduced in 2023.
Startups and small businesses will have some flexibility under the law. Non-profit AI use is also excluded from many restrictions.
Concerns About Timing
Senator Eduardo Gomes highlighted the difficulty of AI regulation at the right time. Acting too early can limit growth while acting too late can lead to problems. The law aims to find a balance.
